This Acceptable Use Policy (“Policy”) governs your use of services provided by Develop Digital Media, LLC doing business as Service Anchor (“Service Anchor,” “we,” “us,” or “our”). This Policy is incorporated by reference into our Terms of Service at getserviceanchor.com/terms-of-service. Capitalized terms not defined here have the meanings given in the Terms of Service.
By using the Service Anchor platform (the “Service”), you agree to comply with this Policy. Violation of this Policy may result in suspension or termination of your account and may also result in legal liability.
1. Prohibited Activities
You agree not to use the Service to:
(a) Send communications that are unlawful, fraudulent, deceptive, harassing, threatening, defamatory, or that infringe on the rights of others.
(b) Send SMS to recipients who have not given the prior express consent required by the Telephone Consumer Protection Act (“TCPA”), the CAN-SPAM Act, applicable state SMS regulations, or carrier requirements including A2P 10DLC.
(c) Send commercial email in violation of the CAN-SPAM Act, including without limitation by failing to include a functioning unsubscribe link, by using deceptive subject lines, or by failing to identify the sender.
(d) Impersonate another person or entity, or misrepresent your affiliation with any person or entity.
(e) Upload, transmit, or distribute malicious code, viruses, ransomware, or any other software designed to compromise the security of any system.
(f) Attempt to gain unauthorized access to the Service, to other tenants’ data, or to any system or network connected to the Service.
(g) Interfere with or disrupt the Service, including by exceeding reasonable use of computational, storage, or messaging resources in a manner that degrades Service performance for other customers.
(h) Use the Service for any illegal purpose, including without limitation fraud, money laundering, evasion of taxes, sanctions evasion, or activity that violates export control laws.
(i) Resell, sublicense, white-label, or redistribute the Service to third parties without our prior written permission.
(j) Use the Service to compete with Service Anchor, including by reverse-engineering, scraping, or extracting data from the Service to build a competing product.
(k) Bypass any access control, rate limit, or security feature of the Service, including by using automated tools to register multiple accounts, generate fake activity, or circumvent usage caps.
2. Prohibited SMS Content (SHAFT and Related)
When you use the Service to send SMS, you must not send any of the following content categories, which are prohibited by the Service Anchor platform, by Twilio, by The Campaign Registry, and by US mobile carriers:
- Sex. Sexually explicit content of any kind.
- Hate. Content that promotes hatred or violence based on race, ethnicity, religion, gender, sexual orientation, disability, or any protected status.
- Alcohol. Marketing or promotion of alcoholic beverages, except in narrow age-gated cases that comply with all applicable carrier requirements.
- Firearms. Marketing or promotion of firearms, ammunition, or related products. Operational SMS by lawful firearms-adjacent businesses (such as concealed-carry training operators) may be permitted on a case-by-case basis with carrier approval.
- Tobacco. Marketing or promotion of tobacco, vaping, e-cigarette, or related products.
- Unauthorized gambling. Promotion of gambling activities not authorized in the recipient’s jurisdiction. State-licensed lottery, casino, and sportsbook operators may use SMS subject to carrier compliance.
- Prescription drugs. Marketing or promotion of prescription medications, including telehealth-prescribed substances, without specific carrier-approved campaign registration.
- Cannabis and cannabis-related products (CBD, hemp-derived THC), regardless of state-level legality. US carriers do not permit cannabis SMS.
- Loan and debt-related solicitations that violate the Fair Debt Collection Practices Act, state collection laws, or carrier rules on high-risk financial categories.
- Cryptocurrency and digital-asset solicitations outside of registered SEC-compliant channels.
These restrictions apply to any commercial or transactional SMS sent through the Service, regardless of how recipient consent was obtained.
3. Prohibited Business Categories
You may not use the Service to operate any business in a category prohibited by Stripe’s Connected Account terms. The current list is maintained at stripe.com/legal/restricted-businesses and is incorporated into this Policy by reference. We may update our enforcement of this list as Stripe updates its own.
In addition to Stripe’s prohibitions, you may not use the Service for any business activity that:
- Is unlawful in the jurisdiction where you operate or where your customers are located.
- Has been the subject of a regulatory enforcement action against you in the past 12 months without remediation.
- Operates in a category we have a reasonable basis to believe creates significant abuse, fraud, or compliance risk.
4. Privacy and Data Protection Obligations
When you load End-Customer Data (defined in our Privacy Policy at getserviceanchor.com/privacy-policy) into the Service, you represent and warrant that:
- You have the legal right and any required consents to collect, store, and process that data, including any rights required by applicable state privacy laws (CCPA, CPRA, and similar).
- You will respond promptly to any privacy request you receive from an end customer (access, correction, deletion, opt-out of sale, opt-out of sharing, etc.) and will use the Service’s tools to assist where applicable.
- You will not load Sensitive Personal Information about end customers (Social Security numbers, financial account numbers, government-issued ID numbers, health information, biometric data, precise geolocation, or similar) into the Service except where necessary for legitimate business purposes and where the data is collected and stored in compliance with applicable law.
5. Reasonable Use
The Service is provided on a fair-use basis. The following activities are presumptively unreasonable and may result in throttling, suspension, or additional charges:
- SMS send rates that materially exceed the rate-limit defaults of your A2P 10DLC campaign category.
- Sustained API call volumes that materially exceed the rate-limit defaults documented in our developer docs (when published).
- Storage of media files, photographs, or attachments that materially exceeds the storage allowance of your subscription tier (when paid pricing launches).
- Automation rule configurations that create runaway loops, cascading triggers, or other patterns that consume disproportionate computational resources.
We will use reasonable efforts to notify you before applying throttling or suspension based on resource use, except in cases where immediate action is required to protect the Service or other customers.
6. Reporting Abuse
If you believe another user of the Service is violating this Policy, or if you have received unwanted SMS or email from a Service Anchor tenant, contact us at compliance@getserviceanchor.com. Please include:
- The nature of the violation.
- The phone number or email address from which you received the communication, if applicable.
- The date and time of the communication.
- Any other information that would help us investigate.
We investigate reports promptly. We are not able to respond to every report individually but will take action where appropriate.
7. Consequences of Violation
Violation of this Policy may result in any of the following, at our sole discretion:
(a) A warning and an opportunity to cure.
(b) Removal or modification of the violating content, message, or account configuration.
(c) Throttling of usage capacity (SMS rate limits, API rate limits, and similar).
(d) Suspension of the affected feature (SMS, voice, payments) without suspending the entire account.
(e) Suspension of the entire account.
(f) Termination of the account in accordance with the Termination provisions of our Terms of Service.
(g) Reporting to law enforcement, carriers, payment processors, or other relevant authorities where the violation involves illegal activity.
(h) Recovery of any chargeback fees, carrier fees, regulatory penalties, or other costs we incur as a result of your violation.
We will use reasonable efforts to notify you before suspending or terminating your account, except in cases of fraud, security risk, imminent harm to the Service or other customers, or cases where notification would interfere with a regulatory or law enforcement process.
8. Cooperation with Investigations
If we receive a request from a government agency, regulator, carrier, payment processor, or court that relates to your use of the Service, we may be required to disclose information about your account, your communications, or your end customers. We will use reasonable efforts to notify you of such a request unless prohibited by law.
You agree to cooperate with us in good faith in any investigation, audit, or enforcement action arising from your use of the Service.
9. Changes to this Policy
We may update this Policy from time to time. When we make material changes, we will:
- Update the “Last updated” date at the top of this Policy.
- Post a notice on the Site or send notice to the email address on file for your account at least 30 days before the change takes effect.
Your continued use of the Service after the effective date of any update constitutes your acceptance of the updated Policy.
